TERMS OF USE - USING YOUR MAYFAIR PRIVATE BANKING CARDS WITH APPLE PAY
1. About Apple Pay and these Terms of Use
1.1. What is Apple Pay?
Apple Pay is a service provided by Apple which enables you to make contactless payments and in-app payments with supported Apple devices using your credit and debit cards, but without having to produce the physical card.
1.2. What are these Terms of Use?
These Terms of Use are an agreement between you and Lloyds Bank plc. and relate to your use of a Mayfair Private Banking card with Apple Pay. By registering a Mayfair Private Banking card with the Apple Pay service you agree to be bound by these Terms of Use.
When we refer to “your card” in these Terms of Use, we mean the Mayfair Private Banking credit or debit card you are registering with Apple Pay. When we say “we” or “us” in these Terms of Use, we mean Lloyds Bank plc. Registered office: 25 Gresham Street, London, EC2V 7HN. Registered in England and Wales No.2065.
1.3. Do any other terms and conditions apply when I use Apple Pay?
Yes. Any other agreements between you and us will continue to apply. Transactions you make using Apple Pay are also governed by the current account or credit card terms and conditions applicable to that card or account in the usual way. These Terms of Use do not form part of any credit agreement you may have with us.
You may also have agreements with third parties in relation to your use of Apple services, such as Apple and other current account providers or credit card issuers whose cards you register with Apple Pay. We are not responsible for any agreements entered into by you with a third party. If you require any support or help to use Apple Pay, please contact Apple in accordance with their procedures for customer support and assistance.
1.4. What do I need to use with Apple Pay?
You must have an eligible card and meet all other eligibility requirements to use your card with Apple Pay. For details of these requirements, please go to www.lloydsbank.com/applepay.
To use an eligible Mayfair Private Banking card with Apple Pay, you also need a supported Apple device and to meet other requirements specified by Apple from time to time. We have no control over these requirements. For more details about requirements imposed by Apple in relation to Apple Pay, including any minimum software and hardware requirements, please go to www.apple.com/uk/apple-pay.
1.5. Are there any other limits or restrictions which apply when I use Apple Pay?
We recommend that from time to time you visit www.apple.com/uk/apple-pay to see if any other limits or restrictions apply to your use of Apple Pay.
2. Charges for using Apple Pay
2.1. Are there any charges for using Apple Pay?
We do not make any additional charges when you use Apple Pay. Any charges, fees and interest which are payable under your current account or credit card terms and conditions are unaffected and will apply in the usual way.
3. Protection and Security
3.1. What must I do to keep my details secure when using Apple Pay?
Your current account or credit card terms and conditions set out certain steps you must take to keep your account and card details secure. Those requirements also apply to the use of your card with Apple Pay.
In addition to those general requirements, you must do all you reasonably can to:
- not leave your Apple device unattended
- use appropriate security on your devices, such as passcodes, passwords and Touch ID. If Touch ID is available on your device, you must ensure you only register your own fingerprints (and not anyone else’s)
- keep confidential your Apple User ID, Apple passwords, passcodes and any other means you have of accessing your Apple device or the information stored on them
- use Apple Pay in accordance with all terms and conditions notified to you which are applicable to Apple Pay.
If you stop using your Apple device (for example, because you get a new device), you must delete all your personal and financial information from your old Apple device.
3.2. What should I do if I suspect any unauthorised use of my Apple device or if my Apple device or security details have been compromised, lost or stolen?
You should tell us as soon as possible by contacting us in the usual way.
If your Apple device is lost or stolen, you should go to www.icloud.com/find or use the Find My iPhone app to suspend or remove the ability to pay from that device with Apple Pay.
4. Responsibilities when using Apple Pay
4.1. What are Lloyds Bank Private Banking responsible for?
We may conduct verification checks when you register your cards with Apple Pay. We also handle your transactions made via Apple Pay using your Mayfair Private Banking cards and those are subject to your credit card or current account terms and conditions. Our and your responsibilities and liabilities under those terms and conditions for payments and transactions are not affected by these Terms of Use.
Our liability for a failure by us to provide services to you with reasonable care and skill is not excluded by these Terms of Use and you may be entitled to remedies such as to require us to perform the relevant service again. We do not limit or exclude our liability to you to the extent that the law says we cannot limit or exclude that liability. For example, we do not limit our liability for acting fraudulently.
4.2. What are Lloyds Bank Private Banking not responsible for?
Except as stated in this section 4, we are not responsible for your use of Apple Pay or for any service, information, software or hardware provided to you by Apple or any other third party. We are not liable for any failures or faults, or any security, availability or performance issues, affecting or relating to Apple Pay or your Apple device.
As this agreement is made with you as a personal customer, we will not be liable for any business losses or costs you suffer (such as loss of business profits or opportunities).
5. Using personal and other information
5.1. How do you use my personal information when I use Apple Pay?
Your personal information is processed in order to allow your Mayfair Private Banking card to be used in the Apple Pay service and in accordance with our privacy notice which you can see here: www.lloydsbank.com/privacy.html. We only share aggregated or anonymised information relating to your card transactions with Apple for these purposes, and in order for Apple to improve and develop its technology, including Apple Pay. Apple and your card network (e.g. Visa, MasterCard and American Express) may also have terms which relate to how your personal information is used by them when you use Apple Pay. You should read any terms that they provide you with. We do not share your identity or information relating to your individual transactions with Apple.
6. Changes and ending this Agreement
6.1. Will Apple Pay change?
Apple may make changes to Apple Pay from time to time. This is outside of our control and you should check with Apple for further information. We may change the way we work with Apple Pay too from time to time, including, for example, how we carry out our verification checks. We will give you notice of any changes which may affect these Terms of Use.
6.2. Will these Terms of Use change?
We may change these Terms of Use from time to time if we have a good reason for needing to make a change. This may be, for example, because of changes in the law, the service we are providing you with or the way Apple Pay works. We will give you reasonable notice of any changes.
6.3. How can this agreement be ended?
You may end your use of your card with Apple Pay at any time by deleting your card details from each of your devices that use Apple Pay. For more information on how to do this please see our Apple Pay FAQs at www.lloydsbank.com/applepay.
We do not promise that Apple Pay will always be available for use with your Mayfair Private Banking card. Where possible we will give you reasonable notice of any plans to end or suspend this agreement but may not be able to do so if there are security or other urgent reasons.
If this agreement ends, you will remain obliged to comply with any other agreements with us which remain in effect.
6.4. How will you tell me about any changes or if this agreement is ending?
We may notify you of any changes to, suspension or termination of this agreement through any means of communication that you have given us your details for and which may be appropriate in the circumstances such as email, SMS or Push notifications, through an app, online banking, or post.
7. Other information
All the information we give you and all communications between you and us will be in English.
These Terms of Use are governed by the law that applies to your applicable Mayfair Private Banking credit card or current account (for example, if English law applies to your account, English law will govern these Terms of Use). The courts of that jurisdiction will also be able to deal with any legal questions connected with these Terms of Use.
We may choose not to enforce or rely on one or more of the terms of this agreement at any time, but we reserve the right to start applying them again at any time.
When giving you notice under this agreement we may use any method for which we have your details and permission.
Apple Pay is a service provided by Apple. When we refer to Apple in these Terms of Use we mean Apple Distribution International an Irish unlimited corporation having its principal place of business at Holly Hill Industrial Estate, Cork, Ireland.

Eligible deposits with us are protected by the Financial Services Compensation Scheme (FSCS). We are covered by the Financial Ombudsman Service (FOS).
